TERMS AND CONDITIONS OF PURCHASE

Welcome to the Favelarte Galeria Suburbana online store.

Favelarte is a gallery dedicated to art, culture, and artistic expressions created within peripheral communities and their territories. In addition to our physical gallery, we make part of our collection available for purchase through our online store.

These Terms and Conditions set out the main rules applicable to purchases made through our website. By completing a purchase, the customer confirms that they are aware of the characteristics of the selected artwork and the conditions described on this page.

1. About the Artworks

The artworks sold by Favelarte are artistic works created by different artists and may include paintings, drawings, photographs, prints, sculptures, objects, and other forms of artistic expression.

The vast majority of the artworks available in our gallery are original and unique, with only one piece available for sale.

Whenever an artwork is part of a limited edition, reproduction, print run, or has more than one unit available, this information will be indicated on the product page whenever applicable.

The main characteristics of each artwork will be presented on its product page and may include information such as:

  • artwork title;

  • artist's name;

  • technique used;

  • materials;

  • dimensions;

  • year of creation;

  • edition or print run, when applicable;

  • photographs;

  • other relevant information.

We recommend that customers carefully read the description before completing their purchase.

2. Photographs, Colors, and Artwork Characteristics

We aim to provide photographs that represent the artworks as accurately as possible.

However, because these are artistic products and, in many cases, handcrafted works, minor characteristics resulting from the technique used may naturally form part of the artwork.

In addition, colors, shades, textures, and details may appear slightly different when viewed on computer screens, mobile phones, or other devices due to each device's brightness, contrast, resolution, and color display settings.

These variations do not affect the authenticity of the artwork.

3. Availability and Unique Artworks

Many of the artworks sold by Favelarte have only one piece available.

For this reason, availability displayed on the website may change quickly.

Adding an artwork to the shopping cart does not, by itself, guarantee that the artwork has been reserved, unless the website expressly states otherwise.

The purchase will be considered completed once the order has been finalized and payment has been confirmed.

Once the sale of a unique artwork has been confirmed, it will no longer be available for further purchases.

If, in exceptional circumstances, the same artwork is purchased simultaneously by more than one customer due to a synchronization issue, technical problem, or similar event, Favelarte will contact the customers involved and take the necessary measures, including issuing a full refund when delivery of the artwork cannot be completed.

4. Prices

Prices displayed on the website are stated in Brazilian Reais (R$).

The price of the artwork will be the amount displayed at the time the purchase is completed, subject to the conditions of the offer available at that time.

Shipping costs, when applicable, will be shown separately during the checkout process and before the order is confirmed.

Promotions, discounts, or special conditions may be subject to specific terms and validity periods, which will be provided together with the respective offer.

5. Payment

Purchases made through the online store require full online payment.

Available payment methods will be displayed during checkout.

An order will only be considered confirmed after the payment has been approved or confirmed by the institution or platform responsible for processing the transaction.

If payment is declined, unauthorized, or not completed, the purchase may not be confirmed and the artwork may remain available for purchase.

Favelarte may use specialized third-party companies to process payments, as also explained in our Privacy Policy.

6. Order Confirmation

After completing the purchase, the customer will receive a confirmation using the contact details provided when placing the order.

This communication may include information such as the order number, artwork purchased, amount paid, delivery or collection method, and other relevant information.

Customers are responsible for providing accurate and up-to-date information at the time of purchase, especially their name, CPF (Brazilian Individual Taxpayer Registry number), email address, telephone number, and address.

7. Delivery Throughout Brazil

Favelarte delivers artworks to addresses throughout Brazil, subject to any logistical restrictions that will be communicated before the purchase is completed.

The cost and estimated delivery time may vary depending on:

  • destination address and postal code (CEP);

  • dimensions and weight of the artwork;

  • packaging requirements;

  • transportation method;

  • need for special handling;

  • availability of the carrier or logistics service.

The estimated delivery time will be provided to the customer during the purchase process or through our customer service channels, depending on the logistics process applicable to the artwork.

8. Packaging and Care of Artworks

Because these are works of art, some pieces may require special care regarding packaging, handling, and transportation.

Favelarte will seek to use packaging appropriate to the characteristics of each artwork in order to preserve its integrity during transportation.

Depending on the artwork's dimensions, weight, technique, or fragility, special transportation arrangements may be required.

Whenever specific conditions relevant to delivery apply, they will be communicated to the customer.

9. Receiving the Artwork

Upon receiving the artwork, we recommend that the customer inspect the external condition of the packaging and, as soon as possible, carefully examine the artwork.

If there are clear signs that the packaging has been tampered with or that the artwork has been damaged during transportation, we recommend that the customer:

  • take photographs or videos of the packaging before opening it;

  • photograph the artwork and any identified damage;

  • keep the packaging used for transportation; and

  • contact Favelarte as soon as possible.

These records help us assess the situation and communicate with the company responsible for transportation.

The customer's rights under applicable consumer protection laws remain fully protected regardless of these recommendations.

10. In-Person Collection

In addition to delivery, customers may choose to collect their artwork in person from Favelarte Galeria Suburbana when this option is available at the time of purchase.

The artwork must be collected at the address and under the conditions provided by the gallery.

Customers must wait for confirmation that the artwork is ready for collection before visiting the gallery.

For purchase security purposes, the customer may be required to present identification or provide information related to the order.

If another person collects the artwork on behalf of the customer, Favelarte may require prior authorization and identification of the person responsible for collection.

11. Cancellation Before Shipping

If a customer wishes to request cancellation of an order before the artwork has been shipped or collected, they should contact Favelarte as soon as possible.

The request will be assessed considering the status of the order and the rights guaranteed under applicable law.

In situations where there is no legal obligation to provide cancellation or a refund, exceptional requests may be assessed individually by Favelarte.

12. Right of Withdrawal for Online Purchases

For purchases made through the online store, consumers have the right of withdrawal provided for under Article 49 of the Brazilian Consumer Protection Code (Law No. 8,078/1990), subject to the conditions and exceptions established by applicable law.

As a general rule, consumers may communicate their decision to withdraw from the purchase within the legal period of 7 (seven) days, calculated in accordance with applicable law.

When the right of withdrawal is properly exercised, the necessary procedures will be carried out for the return of the artwork and reimbursement of the amounts due to the consumer.

To begin the process, the customer must contact Favelarte through the available customer service channels.

Favelarte will provide the necessary instructions for the safe return of the artwork.

Because the product is a work of art, we ask that it be properly packaged for return transportation, preferably using the original packaging and protective materials received, whenever possible.

The exercise of the right of withdrawal may not be made conditional upon keeping the packaging unopened or upon any other requirement that conflicts with the rights guaranteed under applicable law.

13. Customized or Commissioned Artworks

If, in the future, Favelarte offers artworks created specifically on commission or customized according to specifications provided by the customer, specific conditions may be presented before the purchase is made.

In such cases, any different rules regarding cancellation, modification, or return will be communicated in advance and must comply with applicable law.

The fact that an artwork is original, exclusive, or available as a single piece does not, by itself, mean that it is customized or commissioned.

14. Exchanges and Returns

Given the nature of Favelarte's collection, many artworks do not have another identical piece available for replacement.

When an exchange or return is requested due to damage, defects, discrepancies in relation to the product description or offer, or another situation protected by law, Favelarte will assess the case and present the appropriate available options.

When replacement with the same artwork is impossible because it is a unique piece, the alternatives and rights established under applicable law will be observed, including reimbursement where appropriate.

Voluntary requests made outside situations where an exchange or return is legally required may be assessed individually by Favelarte.

15. Artworks Damaged During Transportation

If an artwork is delivered with damage that may have occurred during transportation, the customer should contact Favelarte through our customer service channels.

We will request the information necessary to assess the situation, which may include:

  • order number;

  • photographs of the packaging;

  • photographs of the artwork;

  • detailed photographs of the damage;

  • a description of what occurred.

As many of the artworks we sell are unique, replacement with an identical piece may not be possible.

In such cases, Favelarte will seek to resolve the matter according to the available options and the customer's rights under applicable law.

16. Authenticity and Authorship

Information regarding authorship, technique, edition, year, and other artistic characteristics will be presented according to the information provided by the gallery and the artist.

When an artwork includes a certificate of authenticity, documentation, signature, numbering, or another specific element, this information may be indicated in the artwork's description.

A certificate of authenticity should only be considered included when this is expressly stated on the respective artwork's product page.

17. Copyright

Purchasing a physical work of art does not automatically transfer the copyright associated with the artwork.

The purchase transfers ownership of the physical artwork to the customer, while copyright and other rights associated with the artistic creation remain protected under applicable law unless expressly agreed otherwise.

Therefore, images of the artworks, photographs, texts, names, illustrations, and other protected content may not be reproduced, commercialized, or used in any manner that infringes the copyright or other rights of the artist or third parties.

18. Personal Data

Personal data provided during the purchase process will be processed in accordance with our Privacy Policy and applicable legislation, including Brazil's General Data Protection Law (Lei Geral de Proteção de Dados Pessoais — LGPD).

We recommend that customers review our Privacy Policy before completing their purchase.

19. Responsibility for Information Provided

Customers are responsible for ensuring that the information provided during the purchase process is accurate and up to date.

Incorrect or incomplete information, particularly the address, postal code (CEP), telephone number, and information required for delivery, may result in delays or make delivery impossible.

If delivery cannot be completed because of incorrect information provided by the customer, Favelarte will contact the customer to provide guidance on the next steps and any costs associated with a new delivery attempt, when applicable and permitted by law.

21. Changes to These Terms

Any changes will not retroactively modify the conditions applicable to a purchase that has already been completed, except where necessary to comply with a legal obligation.

The most recent version will be available on this page together with the date of its latest update.

22. Applicable Law

Purchases made through the Favelarte online store are subject to applicable Brazilian law, particularly consumer protection regulations and rules applicable to e-commerce.

Nothing in these Terms shall be interpreted as a waiver or limitation of any rights guaranteed to consumers under Brazilian law.
